Welcome to Checkout Creators (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, services, products, and any related content or tools provided through https://checkoutcreators.com or affiliated domains (collectively, the “Services”). 1. Overview of Services
Checkout Creators provides professional digital services including but not limited to: website design and development, e-commerce store setup (Shopify and others), product/inventory integration, mobile optimization, domain registration, and digital branding consultation. Service packages vary and may be subject to individual agreements.
2. Eligibility
To use our Services, you must be at least 18 years old and capable of entering into a legally binding contract. By using our Services, you represent and warrant that you meet these requirements.
3. Payment and Billing
All payments for services must be made in full or in accordance with the agreement prior to delivery unless otherwise specified in writing. We accept major payment platforms and operate in U.S. dollars (USD). A non-refundable deposit may be required for custom projects. Missed payments or chargebacks will result in the suspension or termination of service.
Checkout Creators reserves the right to modify pricing, billing terms, or subscription offerings at any time. However, any changes will not apply retroactively to ongoing projects or previously agreed-upon packages.
4. Refunds and Cancellations
Due to the customized nature of digital services, all purchases are final and non-refundable, except where required by law. Cancellation of a project must be submitted in writing, and the client may be responsible for payment of completed work up to that point.
5. Intellectual Property
All designs, templates, source code, graphics, and written content created by Checkout Creators remain the intellectual property of the Company unless otherwise agreed upon in writing. Once a project is completed and full payment is received, the client will be granted a non-exclusive, royalty-free license to use the final deliverables for commercial or personal use.
The client affirms that any content (e.g., logos, product photos, copy) provided for use in a project does not infringe on any third-party rights. Checkout Creators is not liable for any disputes arising from materials provided by the client.
6. Client Responsibilities
You agree to provide accurate information and timely communication throughout the project lifecycle. Delays in your responses or failure to provide necessary materials may result in project delays or additional fees.
You are responsible for maintaining your domain registration, store content, legal disclaimers (e.g., privacy policies, shipping info), and business compliance with local laws and regulations.
7. Third-Party Services
Our Services may integrate or involve third-party platforms (e.g., Shopify, Google Fonts, Stripe, PayPal). We are not responsible for the terms, policies, or actions of any third-party service providers. Your use of such platforms is governed by their respective terms.
8. Confidentiality
We respect your business’s confidentiality. Any proprietary or sensitive information shared with us will be kept confidential and not disclosed to third parties unless required by law or with your written consent.
9. Limitation of Liability
To the fullest extent permitted by law, Checkout Creators shall not be liable for any indirect, incidental, special, or consequential damages—including lost profits, lost data, or business interruption—arising from your use of our Services or any errors or delays in service delivery.
Our total liability, whether in contract, tort, or otherwise, is limited to the amount you paid us for the specific service in dispute.
10. Termination
We reserve the right to terminate or suspend access to our Services at any time for violation of these Terms or for any conduct that, in our sole discretion, harms the integrity or reputation of Checkout Creators or other users.
Upon termination, you will no longer be entitled to access deliverables, files, or content not yet paid for.
11. Changes to Terms
We reserve the right to modify or update these Terms at any time without prior notice. Continued use of our Services after any such updates constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in Hillsborough County, Florida.
